Regulatory agencies in Canada at the time of installation of the fireproofing asbestos spray had not certified the use of non-asbestos versions of the fireproof products. Therefore, the installation of asbestos products was a necessity for the safe operation of the vehicles, and further, proof of "damage" or health effects based on previous rulings was difficult. The case was settled out of court. |
